Privacy policy

How we handle the personal data you give us through this website, under Regulation (EU) 2016/679 and Ley Orgánica 3/2018.

Data controller

CLAVERIA ABOGADOS, S.L. (NIF B24960270) · C/ Olivar 1, 2.º D · 28691 Villanueva de la Cañada (Madrid), Spain · 91 811 75 75 · secretaria@claveria-abogados.com

What data we handle, and why

We handle only the data you give us:

  • Contact form and email: name and surname, telephone, email address, the area the matter belongs to and the description you write. Purpose: to deal with and answer your enquiry.
  • Telephone call or WhatsApp: the data you give us in the conversation, for the same purpose.
  • Clients of the firm: in addition, the data needed to provide the legal service, to invoice, and to comply with the firm’s legal obligations.

We do not profile you, we take no automated decisions, and we do not use your data to send you marketing.

Legal basis

  • Enquiry before instructing us: your consent, and steps taken at your request before entering into a contract (arts. 6(1)(a) and 6(1)(b) GDPR).
  • Providing the legal service: performance of the contract for services (art. 6(1)(b) GDPR).
  • Accounting, tax and anti-money-laundering obligations: compliance with legal obligations (art. 6(1)(c) GDPR).

Special categories of data

A legal matter may involve sensitive data — about health, criminal matters or family life. Where you give us such data so that we can advise you, the processing is based on the establishment, exercise or defence of legal claims (art. 9(2)(f) GDPR). We recommend that you do not put health data, criminal data or third parties’ data in the web form: describe the matter in general terms, and we will deal with the detail at the meeting or through a secure channel.

How long we keep it

  • Enquiries that do not lead to an instruction: kept for as long as needed to answer you and, afterwards, for a reasonable period to evidence the attention given, after which they are deleted.
  • Client files: for the duration of the instruction and, afterwards, for the limitation periods applicable to professional liability claims and those required by tax, accounting and anti-money-laundering rules.

Recipients

Your data is not passed to third parties for commercial purposes. Where the matter requires it, it may be disclosed to courts and tribunals, public authorities, procuradores, experts, notaries and the opposing party within the proceedings. Our web hosting provider and our email provider access the data as processors, under a contract concluded in accordance with art. 28 GDPR.

Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw any consent given, by writing to secretaria@claveria-abogados.com or to the firm’s postal address, enclosing a copy of a document proving your identity. If you consider that the processing does not comply with the rules, you may complain to the Spanish Data Protection Agency (www.aepd.es).

Professional privilege

Independently of all the above, everything you tell us is covered by a lawyer’s professional secrecy, whether or not the instruction goes ahead. It is a professional-conduct obligation stricter than data protection law itself.

Security

We apply reasonable technical and organisational measures to protect the information. Even so, no transmission over the internet is completely secure: for sensitive documents, please prefer delivery at the office.
